On January 9, 2018, at approximately 5:40 p.m., a Timmins Police officer on patrol observed driving behaviour consistent with stunt driving. Police conducted a traffic stop and spoke to the driver of the vehicle.

During the course of the interaction, an assault was committed on the officer issuing the Provincial Offence Notices.

As a result of the traffic infractions and assault, Kyle MCWILLIAM, 19, of Timmins faces charges of:

  • Stunt Driving (Highway Traffic Act)
  • Drive motor vehicle, no currently validated permit (Highway Traffic Act)
  • Fail to have insurance card (Compulsory Automobile Insurance Act)
  • Assault Peace Officer (Criminal Code of Canada)

In relation to the Criminal Code charge, the accused was released on a promise to appear in court, with a future court date of February 13, 2018.

Several infractions constitute stunt driving. This can include driving at a rate of speed that is a marked departure from the lawful rate of speed, driving that indicates an intention to spin or cause the vehicle to circle, without maintaining control, or driving that indicates an intention to cause some or all of its tires to lose traction with the surface of the highway while turning, among others.

Immediate penalties for stunt driving include the seizure of the vehicle involved for seven days, as well as the suspension of the driver’s license for seven days.

Upon conviction, penalties can include a fine between $2000 and $10,000, possible license suspension up to two years, and seven demerit points.
