**KIRKLAND LAKE OPP NEWS RELEASE**


On December 11, 2018, members of the Kirkland Lake Detachment of Ontario Provincial Police (OPP) responded to a collision involving a motorized snow vehicle (MSV) and a pedestrian on Lebel Avenue in the Town of Kirkland Lake, Ontario.  

The pedestrian was brought to hospital with a major leg injury after being struck by a MSV. Police were advised that the operator of the MSV fled the scene.  

As a result of the police investigation into this collision, the OPP have charged three people.  

David EMBERLY, age 43, of Kirkland Lake, Ontario, has been charged with the following:  

  •  Dangerous Operation Causing Bodily Harm, contrary to section 320.13(2) of the Criminal Code (CC),
  • Fail to Stop at Accident Resulting in Bodily Harm, contrary to section 320.16(2) of the CC,
  • Operation While Prohibited, contrary to section 320.18 of the CC,
  • Fail to Report – Circumstances of Collision, contrary to section 13(1)(c) of the Motorized Snow Vehicles Act (MSVA), and
  • Speeding, contrary to section 16, Ontario regulation (O.reg) 804 of the MSVA.

 

The accused is scheduled to appear before the Ontario Court of Justice in Kirkland Lake, Ontario, on March 21, 2019.

 

Jayden DELL, age 22, of Kirkland Lake, Ontario, has been charged with the following:  

  • Fail to Comply with Recognizance, contrary to section 145(3) of the CC, and
  • Fail to Report – Circumstances of a Collision, contrary to section 13(1)(c) of the MSVA.

 

The accused is scheduled to appear before the Ontario Court of Justice in Kirkland Lake, Ontario, on March 21, 2019.

 

Mitchell LAMBERT, age 20, of Kirkland Lake, Ontario, has been charged with the following:

  •  Fail to Report – Circumstances of a Collision, contrary to section 13(1)(c) of the MSVA, and
  • Speeding, contrary to section 16, Ontario regulation (O.reg) 804 of the MSVA.

 

The accused is scheduled to appear before the Ontario Court of Justice in Kirkland Lake, Ontario, on April 2, 2019.
